1. Eligibility

You must be at least 13 years of age to use Orie. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of the App

Orie is a calorie and nutrition tracking iOS application that allows users to:

• Log food entries and retrieve nutritional information via AI-assisted data services
• Track daily calorie intake against personalised goals
• Monitor macronutrient consumption (protein, carbohydrates, and fat)
• View progress, streaks, and earn achievements based on goal adherence
• Receive push notifications and Live Activity widgets for real-time calorie updates

Orie is a general wellness tool and is not a medical device. The nutritional information provided by the App is for informational purposes only and should not be used as a substitute for professional medical, dietary, or nutritional advice.

3. Account Registration

To use Orie, you must create an account using a valid email address and password. You agree to:

• Provide accurate and truthful registration information
• Keep your login credentials confidential
• Notify us immediately of any unauthorised access to your account
• Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we believe have been compromised.

4. Subscriptions & Payments

Orie offers subscription-based access to premium features. By purchasing a subscription, you agree to the following:

• Subscriptions are billed through your Apple ID account via the App Store. Payment is charged at confirmation of purchase.
• Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• You can manage and cancel your subscription at any time through your Apple ID account settings.
• No refunds are issued for partially used subscription periods, except where required by applicable law.
• We reserve the right to change subscription pricing. Any price changes will take effect at the start of your next billing period, with prior notice provided.

All billing and payment processing is handled by Apple. We do not store your payment information. Apple's terms of sale and refund policies apply to all transactions.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, or disassemble any part of the App
• Access or attempt to access other users' accounts or data
• Submit false, misleading, or fraudulent information
• Interfere with or disrupt the App's servers, infrastructure, or security features
• Use automated tools (bots, scrapers, etc.) to access or interact with the App
• Resell, sublicense, or otherwise commercially exploit the App or its content

6. Health Disclaimer

Orie provides calorie and nutrition tracking tools for general informational and wellness purposes only. The App is not a medical device, and nothing in the App constitutes medical advice, diagnosis, or treatment. Nutritional data retrieved via third-party AI services may not be 100% accurate for all foods or preparations.

Always consult a qualified healthcare professional, registered dietitian, or physician before making significant changes to your diet or nutrition plan, particularly if you have a medical condition, eating disorder, or specific health needs. You use the App's nutritional information at your own risk.

7. Intellectual Property

All content within the App, including but not limited to the name "Orie", logo, design, interface, text, graphics, and software, is owned by or licensed to us and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App solely for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from any part of the App without our prior written consent.

8. User Data & Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your data as described in the Privacy Policy. You retain ownership of the personal data and food logs you enter into the App. We do not sell your data to third parties.

9. Third-Party Services

The App integrates with third-party services including Supabase (database and authentication), Perplexity AI (nutritional data lookup), and Apple (payments and App Store distribution). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices, availability, or accuracy of any third-party service.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free from bugs, viruses, or other harmful components. We do not warrant the accuracy or completeness of any nutritional data provided through the App.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Orie and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to loss of data, health outcomes based on App information, or loss of revenue. Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if we determine that you have violated these Terms or for any other reason at our discretion. Upon termination, your right to use the App ceases immediately. You may also delete your account at any time through the App settings. Sections of these Terms that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will remain in effect.

13. Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Where changes are material, we will make reasonable efforts to notify you (such as via a notice within the App). Continued use of the App after updated Terms are posted constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in Delaware.
